AT&T UNLOCKED GAMES 2.0 CONTEST

Official Rules (“OFFICIAL RULES”)


Summary

The AT&T Unlocked Games 2.0 Contest (the “Contest”) is looking for video games that are in at least an early beta version and where the Lead Developer is a woman (as defined below). AT&T will award three (3) prize packages that include prize money to help push the game over the finish line, and provide the Lead Developer the opportunity for her game to be played by a top tier gamer on Twitch to help promote her title. There are no requirements in terms of game subject matter or genre, but games should not have excessive violence, nudity or drug use.

In order to qualify for the Contest, Entrants (defined below) must comply with ALL of the following Official Rules and Eligibility Requirements. Failure to comply with these Official Rules and Eligibility Requirements will render a submission ineligible.


  1. ELIGIBILITY: This Contest is only open to legal residents of the fifty (50) United States, the District of Columbia, and Puerto Rico (the “Eligibility Area”), who are women and 18 years of age or older at the time of entry. For purposes of this Contest, a woman is anyone who was born a female or identifies as one.  Entrants must also be the Lead Developer of the game submitted for entry. For purposes of this contest, the “Lead Developer” is defined as someone who is the lead for at least one (1) major workstream of the project (i.e., development, design, storyboard, sound, levels, programming, artist). Employees of AT&T (“AT&T” or “Sponsor”), Wasserman Media Group LLC (“Wasserman” OR “Administrator”), and any promotional or other vendor agency involved in the design, administration or fulfillment of the Contest (and any other person engaged to work on this Contest) and each of the above’s respective affiliates (collectively, the “Contest Entities”) and the household members (whether related or not) and immediate family members (defined for the purposes of this Contest as a parent, spouse, child, and sibling) of such employees are not eligible to enter or win. Contest is subject to all federal, state, and local laws and regulations. Former AT&T Unlocked Games Winners and Finalists are not eligible to submit their game in any future Unlocked Games contest. Former Unlocked Games Winners and Finalists are eligible to submit a new beta game that has not yet been submitted to any Unlocked Games contest before, two years after their first appearance (i.e., Unlocked Games Winners and Finalists from Unlocked Games 1.0 in 2020 may not submit a new game until Unlocked Games 3.0).  Void where prohibited or restricted by law.

IMPORTANT NOTE: Participants who submitted a game in the 2020 AT&T Unlocked Games Showcase (referred to hereafter as 1.0) and were not declared to be a Finalist may submit the same game in this Contest only if modifications are made prior to submission.


TIMING: Entry for this Contest begins at [12:00pm PDT] on November 1, 2021 and entry in the Contest ends at [11:59pm PST] on January 7, 2022 (“Initial Entry Period”). Thereafter, as detailed below, six (6) Finalists (defined below) will be determined, who will be required to answer judges’ questions and present their game, live on stream during the AT&T Unlocked Games 2.0 Contest on March 08, 2022. Finalists will be determined and notified on or about January 28, 2022. The Administrator’s computer is the official timekeeping device for this Contest.  NOTE: Sponsor and Administrator reserve the right to change any and all dates and times if deemed necessary, at their sole discretion.


  1. HOW TO ENTER: There is no purchase necessary to enter or win. All applicants must enter the Contest via the AT&T Unlocked Games microsite at www.attunlockedgames.com (the “Contest Site”). To enter the Contest, you must fully complete the online application form, available at the Contest Site during the Initial Entry Period, which will include the following: 
    1. Contact information for the Lead Developer:
    2. Basic game information including:
      1. Name of game
      2. Expected Play-Through (total estimated time to complete all levels)
      3. Platforms (PC, Mobile, Console)
      4. Genre (MOBA, FPS, RPG, etc.)
      5. Brief Description of game (280-character limit)
      6. Current expected Launch Date 
    3. A three (3) minute video introducing Lead Developer/Lead Developer team, backstory, game, etc. via an online-streaming source (YouTube, Vimeo) that should answer/address the specific questions listed on the Contest Site regarding the lead developer, game and the importance of the AT&T Unlocked Games initiative:
    4. A playable game demo that must be a minimum of seven (7) consecutive minutes in length (there is no maximum length). Game must be in at least early beta stages and must be submitted via an online-streaming source (YouTube, Vimeo).  
    5. A budget top sheet or summary that reflects how the $100,000 grand prize award could be used to finalize game development and/or offset game development costs.


  1. CONDITIONS OF ENTRY
    1. A Lead Developer may only submit an entry for one (1) game. Only one (1) entry submission per game may be submitted.  Any subsequent submission by a Lead Developer who already submitted an entry or for a game that has already been submitted as part of an entry will be disqualified. Every member working on a game that is submitted by the Lead Developer is considered a part of that game and associated entry.  Limit one (1) entry per person. Limit one (1) entry per game.


    1. Former AT&T Unlocked Games Winners and Finalists are not eligible for the following season after their win, e.g., Finalists and Winners from AT&T Unlocked Games 1.0 are not eligible for 2.0.
    2. Each entry must meet the following criteria in order to be considered:


      1. Must be original, unpublished beta game that does not contain use of any content, element or material that is owned by a third party or violates a third party’s intellectual property rights in any way.
      2. Must not contain any content that 1) promotes hatred or harm against any group or person, or 2) is inappropriate, profane, indecent, sexual, discriminatory, torturous or slanderous as determined by Sponsor in its sole discretion.
      3. Must not be offensive, derogatory, threatening, disparaging or defamatory as determined by Sponsor in its sole discretion.
      4. Must not contain any content or element that is considered unlawful, or in violation of or contrary to any applicable federal, state or local law or regulation.
      5. Must not contain any content, element or material that displays any third-party advertising, slogan, logo, trademark or representation of characters indicating a sponsorship or endorsement by a third party, as determined by AT&T in its sole discretion.
      6. Must not include any disparaging remarks relating to AT&T. Entry must not have been distributed online, on any platform, showcased at any physical location, or have aired on any form of television, internet streaming, or public screening prior to submission or outside of Contest.
      7. Entry (defined below) must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity without permissionIf the Entry contains any material or elements that are not owned by the Entrant, and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any Entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. 
    1. When submitting footage via online streaming URL: Links embedded in your online application must redirect to a streaming website where we may access your footage. PLEASE NOTE: You must not remove your footage from submitted link, or revoke access to submitted link, at any time from the time of submitting your entry until the completion of the competition.
    2. The Lead Developer will be the main point of contact and conduit for all communications, prizing and documentation. If chosen as one of the Finalists, Lead Developer is expected to act solely as the “voice” of the campaign during the Unlocked Games 2.0 Contest Stream on March 1, 2022 and in all promotional materials.


Please note that submitted Entries will not be considered complete until all of the materials are received.  Entrants are encouraged to select the “Intend to Submit” box on www.attunlockedgames.com to notify AT&T of their interest in participation. AT&T Unlocked Games will then remind intended Entrants to submit their games prior to the end of the Initial Entry Period on January 7, 2022. Successful submissions, complying with all of the above, may be referred to hereafter as an “Entry” and each eligible individual submitting such Entry an “Entrant.” Contest Entities are not responsible for lost, late, stolen, mutilated, misdirected or incomplete Entries or Entries in excess of the stated limits herein. If disputed, Entries will be deemed submitted by the authorized account holder of the email address or other method used to enter. 


  1. USE OF YOUR ENTRY: All of the individual(s) included in the submission of an Entry may be referred to hereafter individually AND collectively as “you” or “your.” Contest Entities are not claiming ownership rights to your Entry, however, by submitting an Entry in the Contest, you agree to grant AT&T an irrevocable, royalty-free, worldwide right and license to use, review, assess, test and otherwise analyze your Entry and all its content in connection with this Contest and use your Entry, or any part(s) thereof, in any media whatsoever now known or later invented for any non-commercial or commercial purpose, including, but not limited to, the marketing, sale or promotion of AT&T products or services and/or promotion of AT&T Unlocked Games, without further permission from you. You will not receive any further compensation or credit for use of your Entry, other than what is described in these Official Rules.

By submitting an Entry, you acknowledge that Sponsor or any of the Contest Entities may have developed or commissioned materials similar or identical to your Entry and you waive any claims resulting from any similarities to your Entry. Further, you understand that AT&T or any of the Contest Entities will not restrict work assignments of representatives who have had access to your Entry and you agree that use of information in our AT&T or Contest Entities’ representatives’ unaided memories in the development or deployment of AT&T products or services does not create liability for AT&T or any of the Contest Entities under this agreement or copyright or trade secret law.



  1. JUDGING AND WINNER DETERMINATION: 
    1. The six (6) Finalists will be selected according to the following Game-Evaluating Criteria (defined and detailed below):

Starting on or after January 8, 2022, a qualified panel of judges will judge all the Entries and give each a score of up to 100 points based on the following criteria: Visuals (20 points) – This will judge the quality of visual display, overall aesthetics, audio elements, graphics and overall virtual look and feel. Audio Design (20 points) – This will judge the quality of sound effects and musical score. Gameplay and Mechanics (30 points) – This will judge the quality and ease of gameplay in all aspects (characters, levels, assigned controls/functions, character responsiveness, maneuvering through storyline). Creativity/Story (30 points)– This will judge the Quality of original idea and concept, new and fresh approach to content and delivery to consumers and quality of game narrative, if anyA detailed explanation of the “Game Evaluating Criteria” can be found here: www.attunlockedgames.com. Any Entries scoring less than sixty (60) points in the initial round of judging will not be considered. Contest Entities reserve the right to select fewer Finalists/Winners if an insufficient number of qualified Entries are received.  


Based on the first round of judging, the Twelve (12) Entries with the twelve (12) highest scores will be determined to be the semi-finalists.  Then a second round of judging will commence, and each Entry will be reviewed by AT&T and a panel of six (6) judges (the six judges are referred to hereafter as “End Bosses”), based on the same Game-Evaluating Criteria. On or about January 28, 2022 the six (6) Entries with the highest cumulative scores through their two (2) rounds of judging will be identified as the “Finalists”. Note: In the event of a tie for the sixth slot, the End Bosses and AT&T will each vote on which Entry will move forward in the AT&T Unlocked Games 2.0 Contest livestream. The top six (6) Finalists will then need to agree to a pre-interview prior to the AT&T Unlocked Games 2.0 Contest where they will answer a few short questions including but not limited to questions regarding their game, background, and plans for the prizing. During the AT&T Unlocked Games 2.0 livestream on March 8, 2022, the Finalists will showcase their Entries and will again be judged, this time, independent of their earlier scores, based on the same Game-Evaluating Criteria with the added benefit of a short Q&A with the panel of End Bosses, (worth an additional 10 points). The Entry with the highest score from March 08, 2022 (as determined by End Bosses) will be named the “Grand Prize Winner” and the Entry with the second highest score from March 08, 2022 (as determined by End Bosses) will be named the “Runner-Up Prize Winner”. In the event of a tie for the Grand Prize or Runner-Up Prize an AT&T representative will be the tie breaking vote.


    1. Gamers’ Choice Determination: The Gamers’ Choice Winner will be determined by public voting.  During the Twitch live stream for the AT&T Unlocked Games 2.0 Contest, fans will be given a link in the Twitch chat to a poll on www.poll-maker.com/attunlockedgames where they can vote for their favorite game from among the six (6) Finalists’ games. Their vote should be based on the same Game-Evaluating Criteria used by the judging panel (as detailed above). The public voting will open as soon as all six (6) Finalists’ introduction videos have been shared, on or about 5:15:00pm PST on March 8, 2022 and will remain open until on or around 6:30:00pm PST on March 08, 2022. The eligible Finalist receiving the most votes (as determined by Sponsor) will be declared the Gamers’ Choice Prize Winner, any ties will be broken by a vote by the six (6) industry experts. All public “judges” must be 18 years or older and provide his/her email address at time of submitting a vote and will agree to recontacting. Grand Prize Winner and Runner-up Winner remain eligible to win the Gamers’ Choice Prize.


Grand Prize Winner, Runner-Up Prize Winner and Gamers’ Choice Prize Winner are collectively referred to herein as “Winners.” 

  1. FINALIST/WINNER NOTIFICATION AND DOCUMENTATION: 


    1. Finalist Notification: On or around January 28, 2022 the six (6) Finalists will be notified via email and phone that they have been selected to enter the final round, a streaming event to take place at the AT&T Unlocked Games 2.0 Contest site. They will have forty-eight (48) hours from the time the email is sent to verify their eligibility and confirm their availability and willingness to participate in a short pre-interview, pre-production rehearsal on or about March 10, 2022 and the live stream on March 08, 2022. In the event a Finalist does not respond in the 48 hours allotted or is unable to participate in the events of March 10 and March 08, 2022, the next highest scoring Entry will be considered as a Finalist and the notification process will recommence as outlined. All Finalists must agree to have a headshot taken of them (“Photography”) to be used in all AT&T Unlocked Games promotional material and on www.attunlockedgames.com. Photographer to be supplied by and paid for by AT&T and timing to be mutually agreed upon by Finalist and photographer at an agreed upon location.  AT&T retains the rights to utilize this Photography in the advertising and promotion of AT&T Unlocked Games in any and all media, without notice, review, approval, or compensation unless prohibited by law. 


    1. Finalist Documentation: Once a Finalist confirms availability and willingness to participate in the pre-interview, pre-production rehearsal on or about March 10, 2022 and AT&T Unlocked Games 2.0 Contest on March 08, 2022, they will be emailed all potential winner documentation on or about February 12, 2022, which they must complete, have notarized and returned within five (5) days, utilizing the provided pre-paid overnight delivery service air bill. Documents will include an affidavit of eligibility, liability release, and publicity release (where permitted by law), and the appropriate tax documents (collectively, the “Documents”) which must be executed and returned to Wasserman or its designee within five (5) business days from receiving them or the next highest scoring Entry (as determined by judges) will be considered as a Finalist and the notification process will recommence as outlined. 


    1. Winner Notification: During the livestream, at approximately 6:45 PST, the panel of End Bosses will be excused from the livestream for approximately 15 minutes to deliberate on Discord the Grand Prize and Runner Up Winners. At this time, the voting poll for the Gamers’ Choice Winner will be closed and all eligible votes will be tabulated. Once the End Bosses have reached their final decision on Winners and the voting poll is completed, those three (3) Winners (Grand Prize, Runner Up and Gamer’s Choice) will be notified on Discord by the Contest production team and Winners will need to accept or decline the prize. If all three (3) Winners have accepted their prizes, upon return of the End Bosses to the livestream, approximately 15 minutes later, the host(s) will announce the Grand Prize, Runner Up and Gamers’ Choice Winners live on AT&T’s Twitch channel. If any of the Winners choose to decline their prize, the prize will be awarded to the next highest scored competitor (or the entry with the next highest total number of votes as applicable) until the applicable Winner is selected. If the Gamers’ Choice Winner is the same individual as the individual determined to be the Grand Prize Winner or Runner Up Winner, that Winner will be notified of their additional prize and must follow the same process outlined above. 


7. PRIZES: There will be a total of Three (3) Prize Winners: One (1) Grand Prize Winner, one (1) Runner-Up Prize Winner and one (1) Gamer’s Choice Prize Winner. Each will be awarded the specific prizes as detailed below.  


    1.  Grand Prize specifically includes: 
        1. $100,000 to help fund final game development and/or offset game development costs (should adhere to the budget summary provided upon submission of the Entry.)
        2. A cash prize of $35,000 which is intended to provide partial assistance to Winner for additional costs, taxes, or other expenses Winner might incur in connection with the prize.
        3. Influencer Media Partnership. A top tier gamer/streamer will play the Winner’s game on his/her Twitch channel and agrees to a 1:1 Q&A session with the Winner. The gamer/streamer to be selected based off the winning title (estimated value of $10,000).
        4. The production of (1) game trailer up to (3) minutes in length.
        5. Promotional & Marketing support for your game to include up to (10) dedicated posts on AT&T social media channels (Twitter, Instagram); a paid social media program custom-curated between AT&T, Wasserman and developer based on audience and demographic targets (collectively, “Materials”). Final promotional and marketing support materials are at AT&T/Wasserman’s discretion. 
        6. Lifetime membership enrollment in International Game Developers Association, arranged by Wasserman and AT&T.
        7. Free 1-hour mentoring session with all six (6) End Bosses. Schedule to be coordinated directly between the Winner and each End Boss.
        8. Two (2) tickets to the 2022 Indie Game Business Digital Conference.
        9. Feature on the Indie Game Business podcast. To be coordinated directly between Winner and Jay Powell.
        10. A $3,000.00 AMEX Gift Card to purchase AT&T Products that will support game development. 


Any prize distribution is up to the sole discretion of the Lead Developer; AT&T, Wasserman and additional Contest Entities do not take responsibility. Any questions regarding sharing of prize package should be directed to the Lead Developer and Lead Developer only.


The total Approximate Retail Value (“ARV”) of the Grand Prize is $169,320.00


    1. Runner Up Prize specifically includes:
        1. $20,000.00 to help fund final game development and/or offset game development costs (should adhere to the budget summary provided upon submission of the Entry.)
        2. A cash prize of $7,000.00, which is intended to provide partial assistance to Winner for additional costs, taxes, or other expenses winner might incur in connection with the prize.
        3. A $2,500.00 AMEX Gift Card to purchase AT&T Products that will support game development. 
        4. 1-year membership enrollment in International Game Developers Association, arranged by Wasserman and AT&T.
        5. Free 1-hour mentoring session with all six (6) End Bosses. Schedule to be coordinated directly between the Runner Up and each End Boss.
        6. Two (2) tickets to the 2022 Indie Game Business Digital Conference.
        7. Feature on the Indie Game Business podcast. To be coordinated directly between Winner and Jay Powell.



Any prize distribution is up to the sole discretion of the Lead Developer; AT&T, Wasserman and additional Contest Entities do not take responsibility. Any questions regarding sharing of prize package should be directed to the Lead Developer and Lead Developer only.


Total ARV of Runner-Up Prize is $29,580.00


    1. Gamer’s Choice Prize specifically includes:
        1. $10,000.00 to help fund final game development and/or offset game development costs (should adhere to the budget summary provided upon submission of the Entry.)
        2. A cash prize of $3,500.00, which is intended to provide partial assistance to Winner for additional costs, taxes, or other expenses Winner might incur in connection with the prize
        3. A $1,500.00 AMEX Gift Card to purchase AT&T Products that will support game development. 


Any prize distribution is up to the sole discretion of the Lead Developer; AT&T, Wasserman and additional Contest Entities do not take responsibility. Any questions regarding sharing of prize package should be directed to the Lead Developer and Lead Developer only.


If the winner of the Gamers’ Choice Prize is the same as the winner of the Runner Up Prize or Grand Prize, Gamers’ Choice Winner is eligible for both Prize packages.


Total ARV of Gamers’ Choice Prize is $15,000.00


In addition to the specific prizes awarded to each Winner, all three (3) Winners agree to the following additional inclusions: 


  1. ADDITIONAL PRIZE TERMS


Any and all guarantees and warranties for service or merchandise prizes are subject to the service provider’s or manufacturer’s terms and conditions, and winners agree to look solely to such service providers or manufacturers for any such warranty or guarantee claim. Certain conditions and restrictions apply. 


Prizes are not redeemable for cash. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value.


Each Winner must provide to Sponsor a complete and valid IRS Form W-9 prior to receiving prize. The value of prize is taxable to each Winner as income. An IRS Form 1099 will be issued in the name of Winner for the actual value of prize awarded if the aggregate value of prize awarded to and other compensation received by Winner from Sponsor is $600 or greater for the calendar year. All federal, state and local taxes, and any other costs and expenses associated with acceptance and/or use of prizes not specifically provided for in these Official Rules are solely the Winner’s responsibility; however, each winner will receive a cash prize to assist in the payment of taxes as listed above. Sponsor makes no representations to Winner regarding the tax consequences of any prize.


  1. ADDITIONAL TERMS
    1. Release and Choice of Law: By entering, Entrant agrees to accept and abide by the Official Rules of this Contest and agrees that any dispute with regard to the conduct of this Contest, rules interpretation, or award of prize, shall be resolved by Sponsor, whose decision shall be binding and final. By entering, Entrant agrees to be notified by email and phone of the winning Entry by the Sponsor and/or Administrator for the purposes of the administration of this Contest. This Contest is governed by the laws of the State of Texas, and Entrant consents to the exclusive jurisdiction and venue of the Courts of the State of Texas for any disputes arising out of this Contest. All federal, state, and local laws and regulations apply. By participating, Entrant agrees to release and hold harmless the Contest Entities and their respective employees, directors and shareholders (collectively, the “Released Parties”) from any injury, loss or damage to person, including death or property damage due directly or indirectly to the acceptance, use, or misuse of a prize, or part thereof, participation in any Contest-related activity, or participation in the Contest. The Released Parties are not responsible for: any incorrect or inaccurate Submission information; inability to connect with any website, including but not limited to the Contest Site; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, hardware or software, including without limitation any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in the Contest; theft, tampering, destruction, or unauthorized access to, or alteration of, Entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site or for any other reason whatsoever; typographical, printing or other errors; any other Contest related materials which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof.  Entrants, by participating in the Contest, agree that the Released Parties shall have no liability whatsoever for, and shall be held harmless by Entrants against, any liability for any injuries, losses or damages of any kind, including, but not limited to, death or injury to persons, or property loss or damage, relating or resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any award or participation in this Contest.  Proof of attempting to submit an Entry is not considered proof of delivery or receipt.  Illegible or incomplete Entries will be disqualified.   False, fraudulent or deceptive Entries or acts shall render its Entrant(s) ineligible. In the event the Sponsor is prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, actual or threatened public health crisis (including, without limitation, an epidemic or pandemic) or any federal, state, or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event), the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate the Contest the Sponsor reserves the right, but shall have no obligation, to determine the winner(s) based upon the judging process detailed above, from among all valid and eligible Entries received up to the time of such [Majeure event. 
    2. Indemnification and Representations & Warranties: Entrant acknowledges, agrees and warrants that nothing in the Entry infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Entrant, absent a suitable license, clearance or permission agreement (proof of which is required upon submission), or violates any person's rights of privacy or publicity and that all necessary releases and permissions have been secured.  Entrant agrees to indemnify and hold harmless Contest Entities and each of their owners, officers, directors, employees, and affiliated organizations, and their respective officers, directors, shareholders and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by Entrant of these Terms or the warranties and representations made by Entrant in this paragraph.  
    3. Arbitration: Except where prohibited by law, as a condition of participating in this Contest, Entrants agree that (1) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, and not as a participant in any class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.
